Professional Web Hosting

The following policies apply to all customers of Orongo Web Hosting Inc. services. By subscribing to Orongo Web Hosting services, whether directly, through a third party, a representative, or a business partner, YOU ACCEPT THE POLICIES DESCRIBED IN THIS DOCUMENT AND AGREE TO COMPLY WITH THEM. The description of contracted services (or "Service Charter") corresponds to the hosting package description as presented on the Orongo Web Hosting website. In this document, the sections identified by Orongo Web Hosting apply to both shared hosting and dedicated server customers.

General Terms of Agreement

Orongo Web Hosting Inc. commits to providing the customer with Internet connectivity services, hosting space, and Internet traffic as specified in the Service Charter. Orongo Web Hosting Inc. will make all reasonable efforts to ensure the best quality of service to the customer.

Privacy Policy

Orongo Web Hosting Inc. will use personal information provided by the customer only within the framework of its daily operations and will not share such information with third parties without the customer's prior consent, except when required by legal authorities or in the case of collection agencies, if necessary. Orongo Web Hosting may use the customer's business name and provided comments as a reference in its advertising or on its website. The customer may request at any time, by email, that their name or comments not be used.

Internet Connectivity Services

Orongo Web Hosting Inc. commits to providing connectivity services, IP routing, and Internet traffic as specified in the Service Charter. The customer must use the bandwidth in accordance with acceptable use policies.

Other Services

If requested by the customer, Orongo Web Hosting Inc. may, at its discretion, offer technical or non-technical support in addition to its standard services. This includes system restarts, troubleshooting, script review, DNS configuration, among others. Unless otherwise agreed, the customer must pay for these additional services at a rate of 85 USD per hour, billed in blocks of at least 30 minutes.

Hosting Equipment

Orongo Web Hosting is responsible for equipment installation and maintains exclusive ownership of the same. The customer has no ownership rights or direct access to the equipment. Data center visits can be arranged under the supervision of Orongo Web Hosting staff. The customer may not modify or tamper with the equipment under any circumstances.

Immediate Measures for Threats

If Orongo Web Hosting determines that a site or server poses an immediate threat to the integrity of its network, equipment, or user security, it may take necessary measures without prior notice to the customer, without being liable for resulting damages or interruptions. The customer will be notified as soon as possible about the actions taken.

Customer Breach

If the customer breaches any obligation under this agreement, Orongo Web Hosting may:

1. Suspend access to the service without prior notice. 2. In case of non-payment, exercise legal rights to recover debts, including the sale of equipment if applicable.

Payments

  • Recurring monthly payments must be made in advance, according to the period chosen by the customer (monthly, yearly, biennial).
  • The first month of service must be paid when opening the account.
  • Unpaid invoices will generate a compound interest of 2% monthly.
  • Any rejected check or debit will incur a charge of 20 CAD.

Refund Policy

Advance payments are non-refundable after the 30-day guarantee period following service activation. Credits for advance payments may be applied to the purchase of other Orongo Web Hosting products.

Customer Obligations

The customer is responsible for paying their account, even if they do not use it. From the moment an account is opened, resources are assigned and reserved exclusively for the customer.

Guarantees

  • Satisfaction Guarantee: Refund available within the first 30 days after account opening.
  • Network Availability Guarantee: Orongo Web Hosting guarantees 100% network availability.
  • Equipment Replacement Guarantee: Dedicated servers will be replaced within a maximum of 4 hours.

Data Backup

Orongo Web Hosting implements full backups for shared services. However, the customer is responsible for maintaining their own backups.

Applicable Law

This contract is governed by the laws of Quebec, Canada. Both parties agree to submit any dispute to the jurisdiction of the courts of Montreal.
